1. Acceptance. By accessing or using the Chromatory Light Studio (the "Software"), you agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree to these Terms, or if you are ineligible under Section 4, you must not access or use the Software.
2. License; no commercial redistribution. The Software is licensed, not sold. Subject to your continuing compliance with these Terms, you are granted a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Software for personal, non-commercial purposes. You shall not, directly or indirectly: (a) sell, resell, rent, lease, license, sublicense, or otherwise offer the Software or access thereto for consideration; or (b) bundle, package, embed, or distribute the Software with, or as a component of, any product, service, or offering, whether or not for profit.
3. No modification. You shall not modify, adapt, translate, patch, decompile, disassemble, reverse engineer, create derivative works of, or otherwise alter the Software, in whole or in part, nor permit, procure, or assist any third party to do any of the foregoing, except solely to the extent such restriction is prohibited by applicable law.
4. Eligibility. Use of the Software is limited to persons who are not now, and have not at any time previously been, moderators (howsoever titled, and whether full, temporary, probationary, or honorary) of the subreddit known as r/minipainting. By accessing or using the Software you represent and warrant that you do not currently hold, and have never held, any such moderator position. The license granted under Section 2 is void ab initio as to any person in breach of this Section 4.
5. Termination. Any breach of these Terms terminates the license automatically and without notice. Sections 6 through 8 survive termination.
6. Disclaimer of warranty. THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOUR FILES ARE PROCESSED LOCALLY ON YOUR DEVICE; NO WARRANTY IS MADE AS TO RESULTS.
7. Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, MODELS, OR PAINTED MINIATURES, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THESE TERMS.
8. Changes. These Terms may be revised at any time by posting an updated version; continued use of the Software after posting constitutes acceptance of the revised Terms.
